TERMS OF USE

These Terms of Use govern the terms and conditions of use of the platform www.bilheteria.masp.org.br (“Platform”), which sells tickets online for exhibitions and other events promoted or hosted by the São Paulo Museum of Art Assis Chateaubriand, a private non-profit association, headquartered in the city of São Paulo, State of São Paulo, at Avenida Paulista, nº 1578, Cerqueira César, 01310-200, registered with the CNPJ/ME under nº 60.664.745/0001-87 (“MASP”).

The Terms of Use address the rights and duties that you, the user of the Platform (“User”), must observe when navigating it, so it is worth reading carefully. We recommend that every time you access the Platform, you pay attention to possible changes or updates to the content of this document.

BY REGISTERING ON THE PLATFORM, YOU AGREE TO THESE TERMS OF USE. BE AWARE THAT THE PROVISIONS HEREIN WILL REGULATE THE RELATIONSHIP BETWEEN MASP AND THE USER. IF YOU DO NOT AGREE WITH ALL THE TERMS THAT FOLLOW, DO NOT USE OR ACCESS THE PLATFORM.

WE INFORM YOU, IN ADVANCE, THAT WE MAY CHANGE, AT ANY TIME, THESE TERMS OF USE, THE PRIVACY POLICY, AND OTHER PROVISIONS THAT GOVERN THE USE OF THE PLATFORM. Material changes and updates may be sent to the User's registered email, and we may request your acceptance of the new version of the Terms of Use to maintain your access to the Platform. For your convenience, the publication date of the most recent version is at the top of these Terms of Use.

1. The Platform

The MASP ticket platform allows the User to purchase tickets for exhibitions and other events promoted or hosted by MASP, in their own name or naming the tickets for third parties. The provisions of these Terms of Use regulate and apply solely and entirely to the Platform.

2. Adherence together with other terms and policies

The use of the Platform implies adherence to these Terms of Use and the Privacy Policy, available at www.bilheteria.masp.org.br/pt-BR/privacy-policy, both in their most updated versions. The User understands and agrees that the provisions in the MASP policies made available on the Platform also regulate the relationship between MASP and the User (such as the “Sales and Cancellation Policy”), and that acceptance of these Terms of Use implies the User's express agreement to this set of terms and conditions.

3. Access and use of the Platform | Registration

Access to the Platform is free and does not require prior registration by the User. However, to use some features of the Platform, such as purchasing tickets, it is necessary to create an account (“Registration”). Registrations of legal entities must be carried out by a duly authorized representative to represent them.

To register, you must provide the Data specified on the Platform and in our Privacy Policy. The information provided is the sole responsibility of the User. By using the Platform, you declare and guarantee that all the information you have submitted, whether personal or not, is true and accurate, and that you (i) will maintain the truthfulness of any information provided; and (ii) will update your Data whenever necessary.

You are also solely responsible for maintaining the confidentiality of your Registration access information (whether login and password, or access PIN sent to the registered mobile phone) and for all activities that occur in your account. You agree to notify MASP through our service channel (“Service Channel”) described here if you suspect any unauthorized use of your account. MASP will not be responsible for any losses and damages resulting from unauthorized access in cases of User's carelessness or negligence regarding the confidentiality of their access information.

4. User Responsibilities

All equipment (computer, smartphone, tablet), programs (browser), and internet content (such as connection) necessary to access the Platform, as well as security tools and procedures (such as antivirus) that prevent electronic risks, are the sole responsibility of the User.

The User is prohibited, in the use of the Platform, from adopting behaviors that infringe any applicable municipal, state, federal, or international law, including, but not limited to, assuming the personality or identity of another person, whether physical or legal; and practicing any act that, directly or indirectly, in whole or in part, represents an infringement of the rights of MASP or any third parties.

We reserve the right, without any prior notice, to delete the Registration and block User access if we have a well-founded suspicion of data falsification. The same applies to Users who act in disagreement with applicable laws and/or with our Terms of Use, Privacy Policy, and other regulatory provisions for the use of the Platform.

5. Platform Availability

We strive to ensure the operation of MASP without interruptions or errors and with correct, clear, and precise information about the tickets and the functionalities of the Platform.

To the extent possible, we will suspend the use and access to the Platform only in cases of fortuitous events or force majeure (such as cyber-attacks), to minimize risks concerning User information. However, we are not responsible for any damages arising from these cases, as well as for damages resulting from improper use of the Platform or temporary interruptions.

We strive to keep all information on the Platform updated, correct, and accurate. However, if you believe there are errors or technical failures, we ask that you help us resolve them by pointing them out via the Service Channel: atendimento@masp.org.br.

6. Care with the Platform and Data Privacy

We care about the privacy of our Users and are committed to acting in accordance with the terms of the Privacy Policy, developed for your security.

However, the name of MASP is subject to being used by third parties in bad faith in fraudulent schemes, and it is up to the User to be aware of these possible attacks. We inform you that we do not request passwords, usernames, credit card data, and other personal information via email or phone contact. MASP is not responsible for damages resulting from the provision of this information.

If you receive any unsolicited email not provided for in the Terms of Use or Privacy Policy in our name, we ask that you immediately communicate our Service Channel.

7. Term

These Terms of Use will remain in full force and effect as long as the User maintains their Registration active and/or is not replaced by other Terms of Use.

It is the exclusive prerogative of MASP to suspend or terminate the activities of the Platform at any time and without prior notice, without this entailing the right to compensation by the Users.

Registered Users may request the suspension of their Registration on the Platform through our Service Channel.

8. Intellectual Property

The content made available on the Platform, including, but not limited to, trademarks, photographs, texts, and other intellectual works, are protected by the current intellectual property legislation, without prejudice to other legal protections that may apply, and their access through the Platform does not represent, in any way, any authorization for their use by the User.

10. Applicable Law and Competent Jurisdiction

These Terms of Use are subject to the laws in force in Brazil, with express waiver of the application of any other.
